Pinelands CID Safety App: Privacy Policy and End User License Agreement

Welcome to the Pinelands CID app, developed by Idea Pioneers (Pty) Ltd (Pty) Ltd (the “App Owner and Licensor”) for Pinelands CID (the “App Licensee”).
Your privacy is important to us, and this privacy policy explains how we collect, use, and protect your information.

Data Collection and Use:
We collect and use the following types of data:
i. Location Data: We collect your location information when you use certain features, such as the Panic button and Emergency Services. This information is used solely for providing emergency response support and is not shared with third parties.
ii. Third-Party Sharing: For navigation purposes only, we provide your current GPS coordinates to Maps, Waze, and Uber. No personal data is shared.
iii. Consent and Permissions: Location access is requested only with your consent and is necessary for some app features. You may manage permissions through your device settings. If you do not grant location access, some services may be limited.
iv. Data Retention and Deletion: Data is retained only as long as necessary to fulfill its purpose. You may request account deletion via the app or via https://shor.by/Pinelands-CID-appsupport. Account deletion will remove your data within 48 hours.
v. Security Measures: We employ encryption and secure data transmission to protect your information.
vi. Changes to This Privacy Policy: We may update this policy. Significant changes will be communicated via the app. Please review the policy periodically.
vii. Access and Updates: Our privacy policy is available at https://shor.by/Pinelands-CID-appsupport. It is non-editable and publicly accessible from your app store listing and within the app.
1. Introduction
This mobile application (“App”) has been developed and is operated and maintained by Idea Pioneers (Pty) Ltd (Pty) Ltd (the “App Owner and Licensor”) for Pinelands CID (the “App Licensee”).
The App Owner and Licensor and the App Licensee are committed to protecting the privacy of your personal information whilst striving to provide the very best user experience. Under the Protection of Personal Information Act, No. 4 of 2013 and related laws, we have a legal duty to protect the personal information we collect from you.
2. Collection
We will only collect the information you provide to the App Store to register an account. We will only use your information in accordance with this privacy policy.
3. How we use the information that we collect
The relevant App Store owns the information it collects when you acquire, purchase and/or download this App through the App Store. They may share some of that information with us, depending on the selections you have made. We will use it, as applicable, to:
provide you with services or information that you have requested or products or services that you have ordered, such as Apps and subscriptions to Apps;
monitor or improve the performance of, and products and services available through, this App;
monitor compliance with our terms and conditions of use of the App, enforce our rights and protect the safety of others including investigating and if necessary removing any content about which we receive a complaint; and/or
for any purpose if we are required to do so by law or other regulatory or government authority
By providing us with your personal information, you consent to us processing your information as set out in this privacy policy and in any other manner you expressly consent to.
4. Who we may share your personal information with:
Agents: The App Owner and Licensor uses third parties to perform certain functions on our behalf including, but not limited to, updating the App, publishing content, tracking your location, providing navigation information or services, sending notifications, managing your responses, responding to your panic alerts, optimising app performance and tracking analytics.
Aggregate Information: we reserve the right to share aggregate, non-personally identifiable information, such as demographics and App usage statistics, with advertisers, sponsors and other organisations.
Third Party Analytics Services And Tools: we may use analytics services to anonymously collect and analyse user behaviour, engagement and interaction on the app, including but not limited to which pages of the App are viewed and for how long and which links are followed, so that we can provide more content which is of interest to you and improve the user experience (UX). When using our App, statistical analysis may be performed on your usage and behaviour. The analysis of your surfing behaviour is usually anonymous, encrypted and pseudonymized, i.e. meaning that we will not be able to identify you through this data.
5. Maintenance and storage of information:
Your information is collected through the relevant App Store and certain information is passed on to the App Owner and Licensor and App Licensee. We may store that information on servers which are owned and maintained by Idea Pioneers (Pty) Ltd (Pty) Ltd (the “App Owner and Licensor”) and/or on cloud services such as Amazon Web Services. We may keep your information for a reasonable period for the purposes set out in this privacy policy.
6. Links to other websites:
This App may contain links to other websites Notwithstanding this, neither the App Owner and Licensor nor the App Licensee are responsible for the content or privacy policies of these websites or for third party advertisers. Before using such third-party websites, it is incumbent upon you to check each website’s privacy policy.
7. Security:
While every effort will be made to adopt appropriate security procedures to help prevent unauthorised access to your information, Idea Pioneers (Pty) Ltd (Pty) Ltd (the “App Owner and Licensor”) will not be liable for any attempt to hack or crack or otherwise gain access to any of your information on servers owned and maintained by Idea Pioneers (Pty) Ltd (Pty) Ltd.
8. Policy changes:
By using this App you agree to the terms of this privacy policy and our terms of use. We may amend this privacy policy and/or the Terms of Use from time to time. If we do so, an updated version will be available through a link in the App. You will be bound by the new terms upon your continued use of this App.

The data collected on this website and App are processed by the App Licensee (Pinelands CID) and the App Owner and Licensor (Idea Pioneers (Pty) Ltd).

Other data is collected automatically by our IT systems when you visit and use our website and App. This data is primarily technical data such as the browser and operating system you are using or when you accessed the website and App. This data is collected automatically as soon as you enter our website and App.
3. What do we use your data for?
Part of the data is collected to ensure the proper functioning of the website and mobile application. Other data can be used to analyse how visitors use the website and the App.
4. What rights do you have regarding your data?
You always have the right to request information about your stored data, its origin, its recipients, and the purpose of its collection, at no charge. You also have the right to request that your data be corrected, blocked or deleted. Revocation Of Your Consent To The Processing Of Your Data
Many data processing operations are only possible with your express consent. You may revoke your consent at any time with future effect. An informal email to info@pinelandscid.co.za making this request is sufficient. Please note that data processed before we receive your request may still be legally processed.
Right To File Complaints With Regulatory Authorities
If there has been a breach of data protection legislation, the person affected may file a complaint with the competent regulatory authorities. The competent regulatory authority for matters related to data protection legislation is the Information Regulator of South Africa, where Idea Pioneers (Pty) Ltd (Pty) Ltd (the “App Owner and Licensor”) is headquartered. The Information Regulator is an independent body established in terms of section 39 of the Protection of Personal Information Act 4 of 2013. It is subject only to the law and the Constitution of the Republic of South Africa and it is accountable to the National Assembly. The Information Regulator is, among others, empowered to monitor and enforce compliance by public and private bodies with the provisions of the Promotion of Access To Information Act 2 of 2000 , and the Protection Of Personal Information Act 4 of 2013.
Right to Data Portability
You have the right to have data which we process based on your consent or in fulfilment of a contract automatically delivered to yourself or to a third party in a standard, machine-readable format. If you require the direct transfer of data to another responsible party, this will only be done to the extent that it is technically feasible.
Information, Blocking, Deletion
As permitted by law, you have the right to be provided at any time with information free of charge about any of your personal data that is stored, as well as its origin, the recipient and the purpose for which it has been processed. You also have the right to have this data be corrected, blocked or deleted. You can contact us at any time using the address given in our legal notice if you have further questions on the topic of personal data.
Opposition to Promotional Emails
We hereby expressly prohibit the use of contact data published in the context of this App’s legal notice requirements regarding sending promotional and informational materials not expressly requested. The App Licensee and App Owner and Licensor reserve the right to take specific legal action if unsolicited advertising material, such as email spam, is received.

1. ACCEPTANCE OF TERMS
This Final End User License Agreement (“Agreement” or “FEULA”) is a legal agreement
between you (“User”) and both Pinelands CID (Pty) Ltd (“App Sponsor”) and Idea
Pioneers (Pty) Ltd (“The Developer”). By downloading, installing, or using the Pinelands
CID Mobile Application and/or Command Console (the “Software”), you agree to be
bound by these terms. The Software is provided for use to the users/constituents of the
App Sponsor.
If you do not agree to these terms, you must immediately cease use and delete the
Software.
2. NATURE OF THE SOFTWARE: NOT A SECURITY SERVICE
IMPORTANT: The User acknowledges that ShieldForce, and the Pinelands CID mobile
app, is a Communication and Information Software Platform, and the Developer is not a
security company or an emergency responder.
1. Communication Platform Only: You acknowledge that the Software is a
Communication and Information Software Platform intended as a personal
safety tool to facilitate alerts to a designated control room, or to designated
contacts that you add on the mobile app.
2. Developer is a Technology Firm: Idea Pioneers is not a security company, an
emergency responder, or a medical service provider.
3. No Guarantee of Response: The Software facilitates the transmission of alerts.
Neither the Developer nor the App Sponsor guarantees that an alert will be
received, acknowledged, or acted upon, by any third-party responder or the App
Sponsor.
4. Dependent on Infrastructure: Performance is subject to the mobile network
availability, GPS signal accuracy, device battery and hardware functionality. The
Developer, and the App Sponsor, are not liable for signal "dead zones" or
hardware and network failures.
5. Not an Emergency Service Substitute: This Software is not a substitute for
traditional emergency services (e.g., 911, 999, 10111, 112, or 10177 or any
emergency service number applicable to your region.). You should always
contact local emergency services directly if safe to do so.

3. SCOPE OF LICENSE
Subject to your compliance with these terms, the Developer grants you a limited, non-
exclusive, non-transferable, revocable license to use the Software on a compatible
device for personal safety or authorised professional security operations (for
Guards/Managers).
4. ROLE-SPECIFIC OBLIGATIONS
1. Lawful Use: You must use the Software lawfully and as intended.
2. False Alarms: You agree not to trigger "Panic" alerts for non-emergency
purposes. Repeated false alarms may result in service suspension.
3. Role-Specific Duties:
a) App Users / Primary Users: Responsible for maintaining device battery,
GPS settings, and network connectivity. You agree not to trigger "Panic"
alerts for non-emergency or testing purposes unless authorised. False
alarms may result in service suspension.
b) Guard and/or Responder Mode Users: Must maintain strict
confidentiality of User data accessed during a response; recording,
screenshotting or sharing location data, or any confidential data, or any
case/incidence data outside of official duties is strictly prohibited.
c) Command Console users: Responsible for all actions taken under their
credentials. Must maintain strict confidentiality of User data accessed
during a response; recording, screenshotting or sharing location data, or
any confidential data, or any case/incidence data outside of official
duties is strictly prohibited. Access is restricted to authorised personnel
only.

4. Prohibited Acts: You may not decompile, reverse engineer, or attempt to derive
the source code of the Software.
5. Ownership: All content, features, source code, and design rights remain the
exclusive property of the Developer.
6. Restrictions: You may not copy, modify, decompile, or attempt to reverse
engineer any part of the Software.
5. PRIVACY AND DATA (POPIA COMPLIANCE)
1. Compliance: Your use of the Software is subject to the Protection of Personal
Information Act (POPIA) of South Africa.
2. Consent: By using the App/Software, you explicitly consent to the collection and
processing of your real-time geolocation data during an active emergency event.
3. Data Purpose: Your data is used solely for the purpose of facilitating emergency
response and improving system performance.
4. Sovereignty: Your data is managed under the authority of the App Sponsor and
is processed by Idea Pioneers.
5. Date Ownership: The App Sponsor is the sole owner of its User Data, and Idea
Pioneers acts only as the custodian and processor of said data.

6. Third-Party Navigation: GPS coordinates may be shared with third-party
providers (e.g. Maps, Waze, Uber) solely for navigation purposes with your
permission.
7. Retention and Deletion: Data is retained only as long as necessary. You may
request account deletion via the App, which will result in data removal within 7
working days.
6. APP STORE MANDATORY PROVISIONS (APPLE)
1. Acknowledgement: This EULA is concluded between the User and both the
Developer and App Sponsor only, not with Apple Inc. The App Sponsor is solely
responsible for the Software.
2. Maintenance: Apple has no obligation whatsoever to furnish any maintenance
and support services with respect to the Software.
3. Warranty: In the event of any failure of the Software to conform to any
applicable warranty, the User may notify Apple for a refund of the purchase
price (if any); to the maximum extent permitted by law, Apple will have no other
warranty obligation.
4. Third-Party Beneficiary: You acknowledge that Apple and their subsidiaries are
third-party beneficiaries of this EULA and have the right to enforce it against
you.
7. LIMITATION OF LIABILITY AND INDEMNITY
1. Full Developer Indemnity: To the maximum extent permitted by law, the User
hereby fully indemnifies and holds harmless the Developer, its directors, and
employees from any and all claims, losses, or damages (including loss of life or
property) arising from the use or inability to use the Software.
2. Sponsor Indemnity: The User further agrees to indemnify the App Sponsor, its
officers, and control room personnel against any liabilities or costs arising from
the User's misuse of the App or breach of this Agreement.
3. Comprehensive Exclusion: This indemnity includes, without limitation, any
direct, indirect, special, or consequential damages in terms of contract or delict.
4. Technical Errors: The Developer is not responsible for data loss or damages
caused by technical malfunctions, power failures, or unlawful acts such as data
theft.
5. Disclaimer of Damages: Under no circumstances shall the Developer and/or the
App Sponsor be liable for any direct, indirect, incidental, or consequential
damages (including loss of life or property) arising from the use or inability to
use the Software.
6. Liability Cap: Where permitted by law, any aggregate liability shall not exceed
the amount paid by you for the Software only in the preceding 12 months or
USD $1.00.

8. GOVERNING LAW AND JURISDICTION
This Agreement is governed by the laws of the Republic of South Africa. Any disputes
arising from or in connection with this Agreement shall be subject to the exclusive
jurisdiction of the High Court of South Africa, Gauteng Local Division, Johannesburg.
9. TERMINATION
The Developer and/or the App Sponsor reserve(s) the right to terminate your access to
the Software at any time, without notice, for conduct that violates these terms or is
harmful to other users or the Developer’s and/or App Sponsor’s business interests.
10. GRIEVANCE AND SUPPORT PROTOCOL
1. Primary Contact: You explicitly acknowledge that any and all grievances, support
requests, queries, or disputes arising from the use of the Software must be
lodged directly with the App Sponsor.
2. No Direct Recourse to Developer: You agree that the Developer is the
technology provider only and is not responsible for the day-to-day management,
responder coordination, or resolution of user grievances.
3. Contact Details: All grievances must be directed to the App Sponsor via:

and support services with respect to the Software.
3. Warranty: In the event of any failure of the Software to conform to any
applicable warranty, the User may notify Google for a refund of the purchase
price (if any); to the maximum extent permitted by law, Google will have no
other warranty obligation.
4. Third-Party Beneficiary: You acknowledge that Google and their subsidiaries are
third-party beneficiaries of this EULA and have the right to enforce it against
you.
