On your Business Consultation call, your Business Advisor will give you the education you need to feel prepared to make an informed decision about starting your business.

Asset Protection: Protect your privacy and personal wealth

There are two key considerations very few entrepreneurs account for until it’s too late: privacy and protection. When operating a business under an informal structure, your personal information and assets are available for the taking if someone really wants them.

With a formal business entity, most states require that you establish a registered agent. Many states will allow you to be your own registered agent, but that keeps your name and contact information in the public eye. If you want to protect your privacy, we recommend using a third-party registered agent. When you appoint a third-party registered agent, the name and address listed on your entity’s public record is no longer your own. The registered agent will receive formal communications such as legal service of processes or notices from the state and forward them on to your personal address.

To protect your personal assets, we recommend that you establish a formal business entity. Commonly referred to as “the corporate veil of protection,” an LLC or other business entity provides separation between your personal wealth and the assets related to the business. The unfortunate reality is that there are an average of 76 lawsuits filed every minute in the United States. No one wants to get sued, but it’s unfortunately not outside the realm of possibility. Establishing a business entity will ensure that your personal assets are not on the line in the event of legal action.

Business Credit: Increase your funding potential

It’s no secret that having good credit makes your life easier. Want to own a home? You need good credit. Trying to buy a car? You need good credit.

Business credit works the same way. Where a FICO score is tied to your social security number (SSN) and determines your personal credit score, a Paydex score is tied to your business’s employer identification number (EIN) and determines your business’s credit score. Having a good Paydex score significantly increases your potential funding options and extends your runway, giving you a better shot at start-up success.

As most of us know, having good credit isn’t just about the credit score—having a mature credit history is just as, if not more, important than the score itself. That’s why we recommend that you start building business credit as early as possible.

Tax Savings: Keep your hard-earned cash

When you think about taxes, you probably do one of two things: cringe or yawn. We know that taxes aren’t a particularly sexy topic…but if you don’t have a proper business entity structure, you are potentially giving the IRS thousands of dollars more than necessary.

The tax code was designed to benefit business owners and entrepreneurship. In fact, there are more than 250 tax deductions available to the average business owner. Some of them are relatively intuitive—business-related travel expenses, office supplies, contractor fees, and so on. But there are lots of creative tax strategies that most people don’t think about.

For example, the Augusta Rule allows your business to rent your own home, creating a deductible expense for your business and a tax-free income for yourself. Or you can buy a work related vehicle—anything from a work truck to a private jet—and write off the depreciation for major tax savings. You can even pay your own kids without creating a tax liability for them while leveraging the expense as a deduction. Of course these types of deductions are extremely nuanced, so we recommend having a professional help determine which tax strategies are best for you.

Frequently Asked Questions

Everything you need to know about starting your business.

Why should I set up an LLC?

Forming an LLC not only legalizes the business, but also creates separation and protection from your personal life. This is commonly referred to as the “corporate veil of protection.” The LLC separates and protects you and all of your personal assets from any type of liability associated with the business.

What is a registered agent?

When setting up an LLC, you must designate a physical headquarters for the business. PRIME always recommends using the registered agent address in your state for the sake of privacy, rather than your home address. You can still receive mail, bank/credit card statements, vehicle registration and other utilities at your home. This is just the address listed on the public record.

What if I already have an LLC?

If you already have an LLC, PRIME recommends you schedule a complimentary business consultation to ensure it is still active and functioning correctly for your business.

Why should I use PRIME?

PRIME offers a one hour complimentary business consultation to assess your unique situation. Our team will handle all LLC setup, draft an operating agreement and ensure your business is structured the correct way without charging you attorney fees! In addition, PRIME offers lifelong email and phone support for your LLC. Every customer is assigned a business advisor to lead them every step of the way.

When should I set up an LLC?

The moment you start to pursue something and have formally made an intent to be a business owner! You don’t have to make an income to form an LLC.

Can I form an LLC if I’m not a U.S. citizen?

Yes, it is possible for non-U.S. citizens or non-residents to form an entity in the United States. However, the process and requirements may be different than for U.S. citizens and residents. It’s important to consult with an attorney or tax professional familiar with the process.
